Sample SMS Privacy Policy and Terms of Service statements

Before registrering your phone line for SMS messaging you must have a compliant SMS Privacy Policy and SMS Terms of Service.

Written by Eric Range

Overview

Phone registration requires a publicly accessible Privacy Policy and Terms of Service page that clearly explains how SMS (text messaging) and phone call communications are handled, including how phone numbers are collected, used, and shared.

The samples provided here are intended as a starting point and cover key compliance considerations. However, you should review all policies with your institution’s administration and legal counsel before publishing them on your website.

These sample policies are provided for informational purposes only and do not constitute legal advice. Element451 assumes no liability for the use of this sample language, whether in whole or in part.

📌 Note: Industry best practice is to maintain these policies on separate pages or URLs, even if they may sometimes be published together. Clearly defined and distinct policies tend to achieve higher approval rates during regulatory reviews. If policies are combined on a URL, each must be clearly separated with appropriate titles and headers, and presented as distinct, independent documents.

Sample SMS Privacy Policy

If you already have a section on your website for your school's Privacy Policy, this can be folded into the existing, but items related to SMS messaging should be grouped under a section name titled "SMS Privacy Policy."

For higher approval rates we recceomnded a dedicated SMS and Phone Privacy Polciy URL ourside your other web, email or other proivcy polcies
